The ToolsMonk desktop app is free to use and its source code is not published. This page is the agreement that says what you may do with it. It is the same text the installer shows you, and it is what every download channel links to as the licence.
This agreement is between you and ToolsMonk, and it covers the ToolsMonk desktop application for Windows, macOS and Linux, including its installer, its automatic updates and any files it places on your computer. In this document the application is called the Software.
By installing or using the Software you accept this agreement. If you do not accept it, do not install the Software, and remove it if it is already installed.
This agreement covers the Software only. Your use of the ToolsMonk website and the services the Software connects to is governed separately by the Terms of Service and the Privacy Policy.
The Software is free of charge. ToolsMonk grants you a personal, non-exclusive, non-transferable, revocable licence to install and use the Software on as many devices as you like, for personal use and for commercial use inside your own organisation.
You do not need an account, a subscription or a payment to use the Software.
This is a licence to USE the Software. It is not a sale, and no ownership passes to you. ToolsMonk keeps all rights in the Software that this agreement does not expressly grant.
The Software is a desktop client for toolsmonk.com. It presents the ToolsMonk tools in a native window, and it loads them from our servers. It is not a self-contained offline product, and an internet connection is normally required.
Because the tools are delivered over the network, the features available in the Software can change when the service changes. Tools may be added, altered or withdrawn without a new version of the Software being released.
Most tools finish their work on your own computer, and a smaller number send input to a server in order to work at all. Which is which is published, tool by tool, at https://toolsmonk.com/where-your-files-are-processed.
The source code of the Software is not published, and this licence grants you no rights to it. You may not do the following:
Redistribute, resell, rent, sublicense or host the Software, or make the installer available for download from anywhere other than a channel ToolsMonk publishes it on.
Modify, adapt, translate or create derivative works of the Software.
Reverse engineer, decompile or disassemble the Software, or attempt to derive its source code, except to the limited extent that applicable law expressly permits despite this restriction.
Remove, obscure or alter a copyright, trademark or other proprietary notice in the Software.
Repackage or rebrand the Software, or present it as your own product or as being endorsed by ToolsMonk.
Use the Software to break the law, to infringe somebody else's rights, or in a way that damages or overloads the ToolsMonk service.
This licence gives you no rights in the ToolsMonk name, logo or brand. Those are trademarks of ToolsMonk and are not licensed here.
The Software checks for updates and can download them automatically so that you stay on a current and secure version. Updates are installed when you choose to install them, and the Software does not replace itself without you deciding to.
An update may add, change or remove features. Where an update is needed for security, declining it may leave the Software in a state we cannot support.
Updates are delivered from the public ToolsMonk releases repository on GitHub. If you obtained the Software from anywhere other than a channel we publish on, we cannot vouch for what you installed.
ToolsMonk does not claim ownership of anything you open, create or export with the Software. Your files remain yours.
How the service handles your data is described in the Privacy Policy at https://toolsmonk.com/privacy-policy, which applies to the Software as it applies to the website.
The Software does not scan your computer, and it does not read files you have not given to a tool.
The Software is built with open source components, including Electron, which are supplied under their own licences. Those licences apply to those components and are not affected by this agreement. Their terms are available from their respective projects.
Nothing in this agreement restricts a right you hold under an applicable open source licence for a component included in the Software.
The Software is provided as is and as available, without warranty of a kind, whether express or implied. ToolsMonk does not warrant that the Software will be uninterrupted, error free, secure, or fit for a particular purpose.
You are responsible for keeping your own copies of anything that matters to you. Verify important output before you rely on it, especially where the result is legal, financial, medical or otherwise consequential.
Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
To the fullest extent permitted by law, ToolsMonk is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, or lost or corrupted data, arising out of or connected with the Software.
The Software is supplied free of charge, and ToolsMonk's total liability arising out of or connected with the Software is limited to the amount you paid for it, which is zero.
Nothing in this agreement excludes or limits liability that cannot lawfully be excluded or limited.
You may end this licence at a time of your choosing by uninstalling the Software and deleting your copies of it.
This licence ends automatically if you breach it. On ending, you must stop using the Software and remove it from your devices.
ToolsMonk may stop publishing, supporting or updating the Software. Sections 4, 8, 9 and 12 survive the end of this licence.
ToolsMonk may revise this agreement. The current version is always published at https://toolsmonk.com/desktop-license, and the version number and date at the top of this document tell you which one you are reading.
A revision applies to a version of the Software released after the revision. Continuing to use the Software after an update means you accept the agreement shipped with that update.
This agreement is governed by and construed in accordance with applicable laws, without regard to conflict of law principles. This mirrors the Terms of Service so that the two documents cannot point at different jurisdictions.
If a provision of this agreement is held to be unenforceable, the rest stays in force.
